You could receive a payment from a class action settlement.
The Charlotte-Mecklenburg Hospital Authority (CMHA) has agreed to pay $2.5 million to resolve claims of a class of patients who were treated at Atrium Health Urology (AH Urology) between April 1, 2021 and September 22, 2022, who were advised or notified that they should undergo blood tests related to that treatment, who underwent one or more blood tests, and were found not to have an infection.
The Settlement resolves a class action lawsuit alleging that CMHA, in its operation of AH Urology, failed to maintain adequate records to determine whether proper procedures were followed in the sterilization or high-level disinfection of reusable medical instruments. CMHA denies any and all alleged wrongdoing.
The Settlement avoids the costs and risks of continuing the lawsuit (such as going to trial, losing, and getting nothing); pays money to patients like you; and releases your claims against CMHA.
CMHA will pay $2.5 million to resolve the claims of patients who were treated at AH Urology between April 1, 2021 and September 22, 2022, who were advised or notified that they should undergo blood tests related to that treatment, who underwent one or more blood tests, and who were not found to have a new infection.
Court-appointed lawyers will ask the Court to reimburse them for the approximately $35,246.19 in costs they have already expended in pursuing their claims, and for up to 30% of the Settlement amount as fees for investigating the facts and litigating the case. Named Plaintiffs Monica Jackson and Keith Grays will ask the Court for up to $5,000 each as a Service Award for bringing this case on behalf of Settlement Class Members such as yourself.
